Agreement to Terms

In purchasing a subscription or digital product, you agree to these Terms of Use, which constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Megan Collins Jewellery (the “Company”, “we”, “us” or “our”), concerning your access to and use of the website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

The Company provides online digital products aimed at helping jewellery designers grow their businesses (the “Programme”), which may consist of masterclasses, trainings, downloadable resources, online communities, and potential future offerings (the “Products”), all of which may be modified at our sole discretion.

By accessing the Site and/or purchasing any Products, you confirm you have read, understood, and agree to be bound by all Terms. If not, you must discontinue use immediately.

Supplemental terms may be posted from time to time and are incorporated by reference. Continued use of the Site after updates constitutes acceptance of revised Terms.

Intellectual Property Rights

Unless otherwise indicated, the Site and Products are our proprietary property. All content and materials (“Content” and “Marks”) are protected by intellectual property laws and may not be copied, reproduced, republished, sold, licensed, or exploited for commercial purposes without our written permission.

You are granted a limited, non-transferable license for personal use only.

User Representations

By using the Site, you represent and warrant that:

Payments and Fees

Purchasing a digital product constitutes a legally binding contract if accepted by us.

You agree to provide updated and accurate payment details for all purchases.

Prices may change at any time. Sales tax will be added where applicable.

Refund Policy for Digital Products

All digital product sales are final. No refunds will be issued under any circumstances.

By purchasing, you acknowledge and agree that:

  • Digital products provide instant access.

  • Digital products cannot be returned, cancelled, or refunded.

  • No refunds will be granted for change of mind, change in personal circumstances, business direction changes, or inability to complete the material.

  • All bonuses and extensions are non-refundable.

Payment Plans

If you select a payment plan:

You are legally required to complete all payments in full.

Payment plans cannot be cancelled, paused, disputed, or terminated early, regardless of product usage or personal circumstances.

Failure to complete payments may result in:

  • Suspension of access

  • Referral to collections

  • Legal action for the remaining balance

It is your responsibility to review the sales page and these Terms before purchasing.

Marketing & Testimonials

By purchasing any digital product, you grant the Company permission to use your:

  • Feedback

  • Wins and results

  • Testimonials

  • Comments shared via email, DM, chat, or community spaces

  • Screenshots of positive feedback or progress

…for marketing, promotional, and educational purposes.

This may include use on:

  • Websites

  • Sales pages

  • Webinars

  • Social media

  • Emails

  • Advertisements

  • Printed materials

However:

  • No private, sensitive, or personal information will ever be shared.

  • Full names will only be used with your explicit permission.

  • You may opt out at any time by emailing [email protected].

  • We will always honor requests not to be featured.

If you do not wish your feedback or results to be used in marketing, simply notify us and we will exclude all material immediately.

Prohibited Activities

You agree NOT to:

  • Retrieve data to create a database without permission

  • Make unauthorised use of the Site

  • Circumvent or disable security features

  • Defraud or mislead the Company

  • Abuse support services

  • Use automated systems or scrapers

  • Interfere with Site functionality

  • Impersonate other users

  • Transfer or sell your profile

  • Upload harmful or malicious material

  • Disparage or harm the Company

  • Use the Site in violation of laws

Violations may result in account suspension or termination.

User Generated Contributions

The Site may allow you to submit content (“Contributions”). You warrant that:

  • You own or have rights to your Contributions

  • They do not infringe intellectual property

  • They are not harmful or inappropriate

  • They do not violate laws or the rights of others

Violations may result in termination.

Contribution License

By submitting Contributions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, publish, reproduce, distribute, and create derivative works for any commercial or non-commercial purpose.

Third-Party Websites and Content

We are not responsible for third-party websites or content accessed through the Site. Your engagement with third-party content is at your own risk.

Site Management

We reserve the right to monitor the Site and manage it in ways that protect our rights, maintain functionality, and ensure safety.

Limitation of Liability

We and our suppliers will not be liable for:

  • Special or incidental damages

  • Loss of data

  • Costs of replacement services

  • Any amount exceeding the fees paid by you within the previous month

This applies to the fullest extent permitted by law.

General Representation and Warranty

You represent that your use of the Site complies with all laws and does not infringe third-party rights.

Indemnification

Miscellaneous

These Terms constitute the entire agreement. If any provision is deemed invalid, the remaining provisions remain in effect.

We may assign rights at any time. Failure to enforce a provision does not invalidate it.

You waive any defense based on the electronic format of these Terms.

Entire Agreement

These Terms and referenced documents constitute the full agreement between you and the Company and supersede all prior discussions and agreements.
